Federal contractors might be surprised to learn that OFCCP litigation historically takes years and has uncertain outcomes. A reasonable settlement is often the best strategy to resolve an outstanding complaint. Former OFCCP Director Craig Leen provides insight to help employers conciliate and mediate more effectively. This presentation will focus on how and when to engage OFCCP in conciliation or mediation, what to focus on in presenting a settlement to OFCCP, and how to maximize the organization's chances at a reasonable settlement under OFCCP procedures.
