Biden Time:  Changes to Expect Under a Reconstituted National Labor Relations Board

by Jonathon Spitz, JD, of Jackson Lewis, PC, in Atlanta, GA

The current Republican majority of 3-1 on the National Relations Board (NLRB), including one unfilled seat, is anticipated to continue until the end of August 2021. At the end of 2020, the NLRB consisted of four members, one short of capacity. President Biden will fill the open position with a Democrat, resulting in a 3-2 Republican majority. Republican appointee Emanuel’s term ends on August 27, 2021, and he will be replaced by a Democrat, creating a 3-2 Democratic majority. A new majority almost certainly will overturn a number of decisions and precedent issued by the Republican Board appointed by President Trump. Join us for a one hour discussion of changes to expect and what your organization can do to prepare. Topics include: Private property access rules Workplace investigation rules and confidentiality NLRB election rules Bargaining unit standards Employer work rules and policies Joint employer standards Independent contractor status Union dues withholding upon contract expiration Use of employer email for personal reasons Employee misconduct during protected “section 7” activity Protected concerted activity

This is a Zoominar session.   Registrants will receive the link in the confirmation and reminder emails.
